Online Auction Terms and Conditions

Collins Auction.

  1. Definitions

Unless otherwise specifically defined in these Online Auction Terms and Conditions, all definitions shall be in accordance with those specified in Collins' main Terms and Conditions of Service.

  1. Collin’s Role and Limitations

2.1 We do not own or act as custodian and caretaker of the items brought to auction in any manner.

2.2 All information regarding every item we bring to auction, whether facts, history, images, data, or documents related to the items we put up for auction ("Auction Item Information"), is information we have received based on warranties from the seller, where the seller is the one who provides such information entirely by themselves.

2.3 We have no duty to verify the Auction Item Information. Therefore, we cannot guarantee to you that the Auction Item Information will be completely accurate and true. We strongly recommend that you conduct detailed verification of the Auction Item Information before deciding to participate in bidding for items. We can conduct additional verification and screening of Auction Item Information upon your request for an additional fee, which you can directly inquire about with us through our contact channels.

  1. Agreement on Item Bidding

3.1 Participation in item bidding, at any time, under the use of your user account, constitutes a clear indication of your intention to bid, and you acknowledge that you have carefully and thoroughly considered the Auction Item Information for the items you are bidding on to your satisfaction before participating in the auction.

3.2 You warrant that you understand the various limitations of the items you are bidding on, including but not limited to the market value of the items, specific characteristics, defects, or historical information that affects the value of the items you are bidding on.

3.3 You have understood the rules and procedures of the auction in detail before participating in the bidding.

3.4 You acknowledge that the Auction Item Information may be incomplete even though there has been a process to verify the Auction Item Information in detail, and you understand and accept such risks in all respects.

3.5 You shall not conduct bidding with the intention of using fraudulent methods in any form. We reserve the right to suspend your bidding rights without having to notify you immediately if we find that you have engaged in any actions that constitute fraud in the auction, and may consider deleting your user account from the system, as well as taking any necessary actions to suspend, prevent, or mitigate any damage that may occur to the auction.

3.6 You acknowledge that we may consider requiring verification of evidence of your financial capability before allowing you to participate in bidding in cases where the auction has significantly high value, which we will notify you in advance before the auction if it is necessary to carry out such procedures.

  1. Duties and Binding Obligations in Bidding

4.1 You cannot withdraw your bid once you have submitted a bid, including the highest bid made through our proxy bidding system (Max Bid).

4.2 When the auction ends with you as the winning bidder, you shall have the following duties and binding obligations:

(1) Pay the buyer's fee to Collins according to the conditions specified in Section 6

(2) Complete the purchase transaction for the item you won at auction by paying the full amount to the seller within three (3) business days from the auction closing date or within the period agreed upon with the seller

(3) Take any other necessary actions to ensure that the purchase transaction for the item you won at auction is legally complete

(4) We have no responsibility for the condition of the items or delivery of items you won at auction. You are responsible for arranging inspection of the items and agreeing on delivery conditions with the seller yourself.

4.3 Failure to complete the purchase transaction with the seller after winning the auction constitutes a breach of contract with both Collins and the seller. We reserve the right to take any necessary actions, including suspending your user account and taking legal action to demand that you be liable for any damages that may occur to Collins in all respects.

  1. Reserve Price and Unsold Items

5.1 You understand that some auction items may have a minimum selling price set by the seller (Reserve Price). If the price offered by the winning bidder is not greater than or equal to the minimum price set by the seller, your winning bid will not immediately create an obligation to complete the purchase transaction with the seller, and the seller has the right to refuse to sell the item for that winning bid, unless the seller accepts the price offered by the winning bidder as specified in Section 5.2.

5.2 Within 7 days after the auction closes, we have the right to negotiate with the seller to propose that the seller accept the highest price offered by the winning bidder in cases where the highest bid price does not reach the minimum selling price. If the seller accepts, the winning bidder has the obligation to complete the purchase transaction for that item and has all duties and binding obligations under Section 4.2.

  1. Fees and Payment

6.1 When you are the winning bidder according to Section 4, you agree to pay a buyer's fee at the rate of 2.5% of your highest bid price (Winning bid) or a minimum of 50,000 THB for cars, or a minimum of 25,000 THB for motorcycles, or a minimum of 2,000 THB for non vehicle collectibles. You agree to pay immediately upon completion of the auction by bank transfer to our account, credit card, or other agreed methods. You acknowledge that late payment of fees may result in additional fees or we may cancel your bidding rights for that auction. This payment is final and not eligible for refund under any circumstances.

6.2 You are responsible for all costs related to the purchase transaction for items you won at auction, including but not limited to money transfer fees, currency conversion costs, and other related expenses, unless otherwise agreed with the seller.

6.3 When the auction is completed with you as the winning bidder, you must pay the full amount for the lot within no more than 3 business days and take delivery of the lot within 15 business days from the auction end date. If you fail to comply with such requirements, the Company reserves the right to cancel your right to purchase said lot and suspend your right to participate in any future auctions with Collins. You are obligated to pay the difference between the price at which you won the auction and the price at which Collins subsequently sells the lot due to your refusal to purchase.

6.4 Collins reserves the right to collect, use, and disclose information of system users who have been granted the right to participate in auctions to business partners and affiliated companies for the purpose of risk assessment and management, including maintaining the reliability standards of the auction process. This may include disclosure of such information to financial service providers for the purpose of providing financial services related to the Company, within the scope and conditions specified in the Company's Personal Data Protection Policy and in accordance with personal data protection laws.
